PURCHASE TERMS 

North West OT Pty Ltd trading as CRATE Resources A.B.N.76 163 142 185 (we, us, our, or CRATE Resources) makes every effort to be fully transparent at all times. Therefore, we have developed these Purchase Terms (these Terms) to ensure that you are fully aware of your rights with respect to payments and refunds, for our learning resources (Resources) purchased via our CRATE Resources website (our Website).

Your order signifies your agreement to be bound by these Terms, which constitute the agreement between CRATE Resources and you.

You may only make a purchase via our Website if you are aged 18 years or older. If you are aged under 18 years, or the legal age of majority in your jurisdiction, then your parent, guardian or educational institution must agree to these Terms, on your behalf.

PURCHASES

You must provide complete and accurate details at the time of purchasing Resources from us. You may be required to provide additional details upon our request, to ensure the accuracy of your order.

PURCHASE PRICE

All prices quoted on our Website, or relating to any enquiry that you may make with us, are in Australian Dollars (AUD) and exclude GST.

We reserve the right to vary the prices displayed on our Website, from time to time, and without notice to you.

PAYMENT

We accept payment by via PayPal, Visa, Mastercard, American Express, Apple Pay, Google Pay and EFTPOS.

After you make payment for your order, you will receive a transaction confirmation email, which confirms receipt of your order.

In the event that we do not receive cleared funds from you, within 48 hours of you submitting your order with us, we will email you at the email address nominated in your order, to communicate about your payment.

DELIVERY OF RESOURCES

You will receive an electronic copy of Resources that you purchase from us, almost immediately after your order and payment has been processed. If you do not receive the Resources after placing your order, please check your Junk mailbox.

DISCLAIMER

Resources are intended for use by therapists, teachers and parents. Resources are not intended as a diagnostic tool or substitute for professional care. If there are concerns regarding ongoing developmental delay, an evaluation by a qualified professional is recommended.

Every child develops in their own particular manner. Therefore, it is impossible to determine exactly when or how they will achieve any given task or skill. Most important is to be aware of a child’s steady progression of gaining skills.

We cannot and do not guarantee any outcome or results, as a consequence of using the Resources. 

SECURITY

We recognise that protection and safety of information relating to your credit card is very important. Therefore, we provide you with a very safe and stress-free online purchasing experience.

We do not store your credit card details at any time, so we ensure confidence and satisfaction at all times.

PRIVACY

By agreeing to and accepting these Terms, you also agree to our Privacy Policy.

CANCELLATION OF ORDERS

Cancellation by us

CRATE Resources may cancel your order, if for any reason, we are unable to provide you with Resources that you have purchased from us. We will contact you should this occur.

You will not be entitled to claim any additional amounts or seek compensation for any loss, expense or damage (either direct or consequential) or for any loss of time or inconvenience, which may result from such cancellation.

Cancellation by you

You are not permitted to cancel any order, unless expressly agreed to, in writing, by CRATE Resources. We are not under any obligation, legal or otherwise, to agree to cancel any order that you have made, via the Website.

REFUNDS 

If you are concerned about your entitlement to a refund relating to your purchase of a Report, we recommend that you read on to learn about your rights and our obligations to you.

Entitlement to a refund

You will only be entitled to a refund where you have an entitlement under any relevant law, such as the Australian Consumer Law. 

In the event that you believe that you are entitled to a refund, you must provide us with:

• your full name and any other details that we may require from you to confirm your purchase of a Report; and

• the reason for claiming the refund.

Issue of refunds 

If you are entitled to a refund, then the refund will be issued to you via the same payment method used by you to make your original payment to us. Please email us if you have not received your refund within five (5) business days of us notifying you that a refund has been issued.

INTELLECTUAL PROPERTY

Your purchase of Resources from us does not confer upon you, any ownership rights, with respect to Resources. All intellectual property rights associated with Resources, including design, text, images and graphics comprised in Resources, are owned or under licence by CRATE Resources and protected by Australian and international laws. 

By purchasing Resources, via our Website, CRATE Resources grants you a non-exclusive licence to access the Resources for the purpose of assisting to educate children, and for no other purpose. You must not reproduce, copy, modify, share or use Resources for commercial purposes, including sale.

In the event that you do any act that we consider amounts to an infringement of our intellectual property rights, we will not hesitate to enforce our rights against you.

GOVERNING LAW

The laws of New South Wales govern these Terms.
